Eligibility. Sweepstakes (the “Sweepstakes”), when active, are open to natural persons who are legal residents of the United States and District of Columbia, residing in the United States or the District of Columbia, who are at least 18 years old at the time of entry (the “Contestants”). Void outside the USA, and in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. Void where prohibited by law. Employees, officers and directors of Union Street Enterprises, Inc., its legal representatives, affiliates, parents, subsidiaries, advertising, promotional, fulfillment and marketing agencies, and their immediate families (and those living in their respective households), are not eligible to participate or claim a Prize in the Sweepstakes. This Sweepstakes is offered in the U.S. only and shall only be construed and evaluated according to U.S. law. Sponsorship. The Sweepstakes are sponsored by Union Street Enterprises, Inc. (“Sponsor”). Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules. The Sweepstakes are in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand you are providing your information to Sponsor and not to Facebook. You completely release Facebook from any responsibility for the Sweepstakes.
The Prizes. The approximate retail value of all prizes is $100 to $500, depending on the entry page you visited. Entry page prizes include: $100. You are not guaranteed to win a prize and your chance of winning is dependent on the total number of eligible entries received. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be determined solely by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is non-transferrable. Any and all prize related expenses, including without limitation any and all federal, state and local taxes shall be the sole responsibility of the winner. Sponsor reserves the right to withhold taxes from any winning Prize, as appropriate. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
How to Enter. (a) Website Entries. You may enter the Sweepstakes by submitting an entry on the MakeSurveyMoney.com website located at www.MakeSurveyMoney.com (the “Site”), using the entry page for the specific Prize you are interested in. The information that you must provide in order to submit an entry on the Site includes your: (i) full name; (ii) mailing address; (iii) email address; (iv) telephone number; (v) gender; (vi) date of birth; and/or (vii) any other information requested by us on the entry form (“Site Registration Data”). You will receive one (1) regular entry and up to 4 bonus entries each calendar day (in the San Jose, Costa Rica, time zone) (each, a “Calendar Day”) of the Promotion Period during which you complete a Site entry form (each, a “Site Entry”). Please note that your Site Entries will not be deemed complete and validly submitted until you have reached the “Confirmed Entry” site page for each Site Entry, and receive a Promotion Prize number on that page.
(b) Alternative Means of Entry. As an alternative means of entry in the Sweepstakes, you may submit up to 5 mail-in entries each day during the Promotion Period. To complete your mail-in entry, you must include in your letter or postcard your: (i) full name; (ii) mailing address; (iii) email address; (iv) telephone number; (v) gender; (vi) date of birth; and (vii) the name of the Prize you are entering for (collectively, “AMOE Registration Data” and together with the Site Registration Data, the “Registration Data”). Where a participant submits a valid mail-in entry during the Promotion Period, that participant will automatically receive one (1) entry into the Sweepstakes for the Calendar Day that such AMOE is postmarked (each, an “AMOE Entry”). All AMOE Entries must be postmarked at least five (5) days prior to the end of the Promotion Period to be considered valid AMOE entries. Additionally, all AMOE entries must be received within 4 days of the end of the Weekly Promotion Period that their postmark falls within in order to qualify for the associated weekly drawing. Contestants must mail their AMOE Entry to: MakeSurveyMoney.com, PO Box 4668 #23563, New York NY 10163-4668. Each envelope must contain no more than 5 AMOE Entries . Any improperly submitted mail-in entries (i.e. any envelope or postcard containing more than 5 entries or having invalid or incomplete AMOE Registration Data) will be VOID.
(c) General. You may submit either Site Entries or AMOE Entries (each an “Entry”) during each Calendar Day during the Promotion Period but not both. Entries submitted by the same individual in excess of the aforementioned Calendar Day limit, either directly or by using numerous email addresses, registrations, identities or other methods, will be voided. Sponsor reserves the right to reject any Entry that it believes, in its sole discretion, is fraudulent, incomplete or otherwise invalid. By entering the Sweepstakes, you agree to the Sweepstakes winner selection and decisions of Sponsor, which are final and binding in all respects. By entering the Sweepstakes, you agree to receive marketing messages from Sponsor and its third party marketing partners. NO PURCHASE NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. PURCHASING GOODS AND/OR SERVICES OFFERED BY OR THROUGH SPONSOR OR OUR MARKETING PARTNERS WILL NOT INCREASE THE ODDS OF QUALIFYING FOR A PRIZE.
SPONSOR IS NOT RESPONSIBLE FOR REGISTRAITONS, SITE ENTRIES, AMOE ENTRIES, CLAIMS OR NOTICES THAT ARE LOST, LATE, ILLEGIBLE, MISDIRECTED, DAMAGED, INCOMPLETE OR INCORRECT. IF YOU FAIL TO SUBMIT AN ENTRY DURING THE PROMOTION PERIOD FOR ANY REASON INCLUDING, BUT NOT LIMITED TO, WHERE YOU CANNOT ACCESS THE SITE, YOU WILL NOT QUALIFY FOR A PRIZE.
Identification of Contestants. Each Entry will be collected and stored in the Promotion Database. For purposes of these Rules, the “Promotion Database” is defined as the entire list of Entries, identified by email address, collected during the Promotion Period. Sponsor will stop accepting Entries at 11:59 PM San Jose, Cosa Rica, time on 3/31/2025.
The Promotion Period. For purposes of these rules, the “Promotion Period” shall be the period beginning at 12:00 am San Jose, Costa Rica, time (“CST”) on 3/1/2024 and ending at 11:59 PM CST on 3/31/2025.
Weekly Promotion Period. A “Weekly Promotion Period” shall be 7-day periods which start Mondays at 12:00 am CST time and end 11:59 PM CST on Sundays during the Promotion Period.
Winner Selection and Notification. Five (5) business days after the conclusion of each Weekly Promotion Period, Sponsor will randomly select one (1) Entry from the Promotion Database which has an entry date within the Weekly Promotion Period (“Winner Selection”) for each Prize. The potential Prize winners will be notified via email within ten (10) days after Winner Selection (contestants should ensure that their Registration Data is accurate and up to date). The potential Prize winners are subject to eligibility verification. The potential Prize winners may be required to execute a notarized Affidavit of Eligibility and Liability/Publicity Release (“Affidavit”), and return such Affidavit within thirty (30) days following attempted notification.
Non-compliance within this time period may result in forfeiture of the applicable Prize, with an alternative potential Prize winner selected. If both the original potential Prize winner and the alternative potential Prize winner do not comply within the required time periods, Sponsor may elect not to seek any further alternative potential winners for the associated Weekly Promotion Period. In addition, the potential Prize winners may be required to provide picture proof of identification, which may include a driver’s license, passport, voting card or similar government issued identification, and proof that they are the contestants that submitted the applicable winning Entries. The return of a Prize and/or Prize notification as undeliverable may result in forfeiture. In no case shall Sponsor be liable in any manner where a winner has not received notification sent from Sponsor or where Sponsor fails to receive a response from the potential Prize winner within the required response period.
The winning Entries, as well as the associated information of the potential Prize winners, must identically match the records maintained by Sponsor in order for a Prize to be awarded. In the event of a dispute, the information maintained by Sponsor will govern. Entries will be deemed made by the person under whose email address the Entry was submitted, regardless of who actually submitted the Entry.
Odds of Winning. The odds of winning a Prize depend on the number of Entries submitted during each Weekly Promotion Period.
Privacy Policy. The information submitted by contestants and prospective contestants in connection with the Sweepstakes is covered by the Privacy Policy, which is made available on the Site. To the extent that the Privacy Policy is in conflict, or inconsistent, with these Rules as they pertain to the Sweepstakes, these Rules shall take precedence. Limitations on Entries. LIMIT 5 ENTRIES PER PERSON PER EMAIL ADDRESS PER 24 HOURS. No third party entry or entry through any submission service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified. Use of robotic entry devices is strictly prohibited.
Taxes. You are responsible for federal, state and local taxes, if applicable, on anything you earn on the MakeSurveyMoney.com website, including but not limited to any amounts you win from the Sweepstakes.
Severability. Should any part of these Rules be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.
Disqualification. Sponsor, its legal representatives, affiliates, subsidiaries, parent, agencies and each of their respective members, officers, directors, employees and agents, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed computer transmissions or technical failure, jumbled, scrambled or misdirected transmissions, lost Site Entries, AMOE Entries or other error of any kind, whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of the Sweepstakes and/or Site, as solely determined by the Sponsor, will be disqualified. Any use of robots, automated processes, macros, programs or third party methods to submit Sweepstakes entries, and any contestant using any such method, will be disqualified and may be disqualified from any other sweepstakes or promotions provided by Sponsor. If disqualified for any of the above reasons, Sponsor reserves the right to terminate each contestant’s eligibility to participate in the Sweepstakes. In the event that any portion of the Sweepstakes is compromised by viruses, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which in the sole opinion of Sponsor, corrupts or impairs the administration, security, fairness or proper determination of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to suspend or terminate the Sweepstakes or any part of the Sweepstakes, or any combination of the above. Sponsor, its legal representatives, affiliates, subsidiaries, parent, agencies and their respective members, officers, directors, employees and agents are not responsible for any problem with Sweepstakes entry generated by computer hardware or software, error or failure, whatever the cause. Sponsor’s sole responsibility for any irregular Entry is replacement with another Entry in a subsequent Sweepstakes, if available.
WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT A CONTESTANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR- OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms. By entering a Sweepstakes, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor will not be responsible for any injury, damage or loss of any kind arising out of your participation in the Sweepstakes. YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES, INJURIES, OR DAMAGES RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES. Except where prohibited by law, by accepting a prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice, opinions, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
Governing Law. These rules shall be interpreted and enforced in accordance with the laws of the State of New York, without regard to conflicts of law principles. Any and all actions, proceedings and disputes between the parties, irrespective of place of execution or performance, shall be instituted and resolved in the courts of the State of New York, County of New York. Each party consents to the exclusive jurisdiction of the courts of the State of New York, and if federal court is applicable, the Southern District of New York.
Force Majeure. The Sponsor, its legal representatives, affiliates, subsidiaries, parents, agencies and its officers, directors, employees and agents, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or technical failure, lost online entries, jumbled, scrambled or misdirected transmissions, or other error of any kind, whether human, mechanical or electronic.
